Iran allows the Ministry of Justice to sign a protocol with the Iraqi government for the return of assets caused by corruption.

Nouraei & M. Mostafavi Law Offices – July 22, 2024- Tehran-The Council of Ministers, in Resolution No. H62864T/67675 dated 23/04/14030 (July 13, 2024), has decreed that: ” in coordination with the Legal Assistant of the President (International Agreements Affairs) and the Ministry of Foreign Affairs and in compliance with the clause ( t) Article (2) of the law on how to implement a part of Article One Hundred and Sixty (160) of the Constitution approved in 1394 (2015), the Ministry of Justice is allowed to negotiate, pre-sign (initial) and temporarily sign the supplementary document (protocol) in the field of returning assets caused by corruption, foreseen in the supplement to  the Agreement on Legal and Judicial Cooperation in Criminal Matters dated 04/02/1390 (equal to April 24, 2011) between the government of the Islamic Republic of Iran and the government of the Republic of Iraq in the framework of the attached text which is approved by the seal of the government office, and follow up the issue until the final approval.”

 

The ten- article aforementioned text, includes the seizure and confiscation of property and benefits resulting from criminal acts, and the related process and manner of seizure, confiscation, management and return of assets caused by corruption.
