Diya (blood money) applicable in the current Iranian year 1404 (21 March 2025- 19 March 2026)

Nouraei & M. Mostafavi Law Offices – 21 March 2025-Tehran- The amount of full Diya (blood money) was set for the current Iranian year of 1404 (21 March 2025- 19 March 2026).

The head of the Judiciary, in decree No.100/73552/9000 dated 22/12/1403(12 March 2025), has declared for the attention of the Judicial Departments Across the Country as follows:

In the implementation of Article 549 of the Islamic Penal Code, approved in 1392 (2013), and according to the research carried out, the amount of full Diya in Non-haram months is sixteen billion Rials from the beginning of 1404 (21 March 2025- 19 March 2026).

Under Islamic rules, Diya (also known as Diyah‌‌, Diyeh, and Deyeh) is the financial compensation paid to the victim or the heir(s) in bodily harm or death. In addition to Iran, such payment is in the laws of some other countries, like Pakistan, Saudi Arabia, and the United Arab Emirates.

Under Article 549 of the Islamic Punishment Law of 1392 (2013), each year, the head of the Judiciary is obliged to set the amount for the whole Diya payable to a victim’s heir(s) in case of the victim’s death.

According to Iranian law, a male’s Diya is typically considered to be full, and a female’s Diya is generally half the amount of a male’s Diya. This difference is rooted in Islamic decrees. However, it is equal under the third-party insurance policy related to traffic accidents.

In line with Article 554 of the same law, Diya is entitled to Muslims and non-Muslims in equal amounts.

Injuries inflicted on each body part are subject to payment of Diya. The court determines the amount in each case in proportion to the full Diya in line with the related stipulations of the law.

If the offense is committed in the lunar months of Muharram, Rajab, Dhu al-Qa’dah, and Dhu al-Hijjah, one-third of the applicable Diya shall be added to the compensation. Those inviolable months are called Haram (forbidden under religion). Prophet Muhammed has forbidden battle and hostilities during such months.

Diya is payable if demanded by the victim or the heir(s). Failure to pay Diya may result in the perpetrator’s imprisonment.
