Nouraei & M. Mostafavi Law Offices – November 3,2024-Tehran- Iranian citizens are now allowed to send official letters of demand to the governmental organs. So far, such letters have been rejected by the notary public and Judicial Services offices, through which the people’s needs could be addressed and sent to non-governmental entities and natural persons.
The decision of the Court of Administrative Justice in this respect through the decree No. 140331390001755181 dated 24/7/1403 (15 October 2024), which was published in the official newspaper dated 9/8/1403 (30 October 2024) is as follows:
“According to Article 156 of the Law of Procedure of Public and Revolution Courts in Civil Affairs approved in 1379 (2,000): “Any person can demand his rights from another person using a statement before submitting a petition, provided that the deadline for the demand has properly arrived. In general, everyone has the right to send officially a letter of demand (Ezhaarnameh in Farsi) about his dealings and obligations to the other party. The letter of demand will be served by the country’s deeds registration offices or the courts’ offices. According to the note of this article, the deeds registration administration and the court’s office can refuse to send letters of demand that contain immoral and indecent content”.
The court concluded that the article did not indicate discrimination between ordinary people and the Government. Hence, sending letters of demand to the Government organs and its agents is legal and allowed.
