Mostafavi Law Offices – 5 February.2025- According to the announcement of the State Organization for Registration of Deeds and Properties, 16 samples of uniform contracts (without the possibility of reducing or increasing their terms) have been prepared and in implementation of the provisions of Note 2 of Article 3 of the “Law on Obligation for official Registration of Immovable Properties” approved on 6/9/1401 (27 November 2022), will be available to the public from 18 Bahman 1403 (6 February 2025). Thus, the contracting parties can register their contracts directly or through real estate agents on the relevant website through cyberspace and authorized platforms.
According for Note 2 of Article 3, the State Organization for Registration of Deeds and Properties is bound to provide real estate agents and natural and legal persons with access to the online electronic document registration system within one year of the coming into force of the aforesaid Law. Through such facility, the real estate agents and natural and juridical persons can make relevant inquiries regarding the official title deed of the property to be transacted or leased, etc., and then they should register their legal acts, subject to Article (1) of the “Law on Obligation to official Registration of Immovable Properties, only in the available form of uniform and standard contracts (without the possibility of reducing or increasing contractual terms). If the real estate agents and/or the contracting parties wish to change the shape and terms of the uniform contracts, they should do that through the public notary offices.
Article 1 of the aforementioned Law stipulates that various types of contracts related to immovable properties must be registered in the electronic document registration system. Otherwise, except in a few cases, the related contract will not have any legal value and validity, so the courts and arbitrators will not hear the disputes that may arise between the transacting parties.
