Amount of Diya (blood money) Set for the Current Iranian Year 1401 (21 March 2022- 20 March 2023)

Mostafavi Law Offices – 28 March 2022-Tehran-According to the Media Centre of the Iranian Judiciary and by the notification of the Head of the Judiciary, the amount of full Diya (blood money) was set at 6,000,000,000 Rials, for the current Iranian year of 1401 (21 March 2022- 20 March 2023).

Under the Islamic rules, Diya (also spelled as Diyah‌‌, Diyeh and Deyeh) is the financial compensation paid to the victim or the heir(s) in cases of bodily harms or death. Such payment is foreseen in the laws of Iran, Pakistan, Saudi Arabia and the United Arab Emirates.

In accordance with Article 549 of the Islamic Punishment Law of 1392 (2013), each year, head of the Judiciary is obliged to set the amount for the full Diya to be paid to a victim’s heir(s) in case of the victim’s death. The amount of Diya of a female is half of that of a male, but it is equal under the third party insurance policy related to traffic accidents.

In line with Article 554 of the same law, Diya entitled to the Muslims and non-Muslims is of equal amount.

Injuries inflicted on each body part are subject to payment of the Diya. The amount in each case is determined by the court in proportion to the full Diya and as per related stipulations of the law.

If the offence is committed in the lunar months of Muharram, Rajab, Dhu al-Qa’dah, and Dhu al-Hijjah, one third of the applicable Diya shall be added to the compensation. Those inviolable months are called Haram (forbidden under religion), mentioned by Prophet Muhammed as months in which battle and hostilities are forbidden.

Diya is paid if demanded by the victim or his/her heir(s). Failure in payment of Diya may result in imprisonment of the perpetrator.
